MACT

Motor Accident Claims Tribunal, Jodhpur

The Motor Accident Claims Tribunal at Jodhpur decides claims for compensation arising out of road accidents, under the Motor Vehicles Act.

MACT16:9 — the building, from the approach road

Compensation here is a calculation, not a negotiation. For a death claim it is built from the deceased's income, an addition for future prospects, a multiplier fixed by age, a deduction for personal expenses, and conventional heads for loss of estate, funeral expenses and consortium. The Supreme Court has standardised most of this, which means a claim is largely won or lost on proof of income and age.

That is why a salary slip, an income tax return or a proved business income changes the award far more than anything argued at the hearing. Where income cannot be proved, the tribunal falls back on notional income, and the award drops sharply.

There is no longer a hard limitation bar of the kind that used to defeat late claims, but delay still hurts — witnesses move, the vehicle is repaired, and the police record is all that survives.

  • Claims against the insurer of the offending vehicle

What to bring

  • FIR and the police accident report
  • Post-mortem or injury certificate
  • Proof of the deceased's or injured person's income and age
  • Vehicle and insurance particulars, if known
